SOCIAL SECURITY DISABILITY

Have you been denied Disability Benefits by Social Security? Do you need help understanding the process or filing out the application? If so, Pagano & Marks can help.

At Pagano and Marks, we know that living with a disability is a challenge. We understand that you’re fighting battles every day—doing your best to work and provide for your family. We know you don’t have the time or energy to deal with the Social Security system, but we do. And we’re here to help.

If you’re applying for benefits for the first time, we can explain the process and guide you through the application.

If you’ve been denied and need to appeal the decision, we can improve your chances of succeeding on the second try.

If you need representation at your disability hearing, we can make sure you have someone standing in your corner that knows the system and is ready to fight for your rights.

THE INITIAL APPLICATION

You can apply for Social Security Disability benefits online or in person at your local Social Security Office. The application is somewhat long and can be confusing. It deals mostly with your work and medical histories. You need correct, up to date information on your disability, medical treatment, ability to work, and work history to have the best chance of success.

If this all sounds overwhelming, we understand—it can be! If you need help filing out the application or if you have questions about what you should be doing, the attorneys at Pagano & Marks can answer your questions. You can call us any time at (804) 447-1002 to set up a free consultation.

REPRESENTATION

After your initial consultation, we hope you will choose an attorney from Pagano & Marks to assist with your application process. If you do, we will immediately notify Social Security of your decision and begin working to get you the benefits that you deserve.

We understand that applying for benefits can be a long process. The attorneys and staff at Pagano & Marks will be here to answer any questions and work with you along the way.

We will make sure everything is filed on time and coordinate efforts to ensure that your application is as strong as possible.

APPEAL

Unfortunately, many applicants are denied on their first attempt to obtain benefits. That’s okay. We are here to help you with your appeal. If you are denied, you should set up an appointment as soon as possible so that we can get you on the right track before your appeal deadline.

All appeals must be submitted to Social Security within 60 days. If you are denied benefits and you want to appeal the decision, it is vital that you contact an attorney as soon as possible. The quickest way for you to get approved for benefits is to submit a timely appeal.

Appealing Social Security’s initial decision gives you a chance to update your application so that they can take another look. Submitting new evidence is crucial. We can help you gather the necessary material and put the right information in from of the decision makers at Social Security.

“But what if I missed my deadline?” If you failed to appeal within 60 days, we can still help you. You are allowed to reapply as many times as you want for Social Security benefits. Restarting the process will take a little longer, but it won’t stop us from getting you the benefits you deserve.

HEARING

It isn’t unusual to be denied on appeal. It can be disappointing not to receive benefits right away, but being denied allows you to appeal again and request a hearing.

The hearing will either take place in person or over the phone. Unfortunately, you can also wait as long as a year between when you file your appeal and when you actually get a hearing. If you have to wait a year to make your case, you might as well hire the best representation to do it. At Pagano & Marks, we know how important this process is to you and your family. We will do everything we can to help you get the benefits you deserve.

At your hearing, you can be represented by an attorney and make your case in front of an Administrative Law Judge, or “ALJ.” A skilled attorney from Pagano & Marks will ensure that the ALJ hears the best possible arguments and sees all of the evidence. This is your best chance to receive benefits. Make sure you go into the hearing with the right representation—representation you can find at Pagano & Marks.

No matter where you find yourself in the Social Security process—initial application, appeal, or final hearing, the attorneys at Pagano & Marks can help. If you need help with the application, and especially if you’ve already been denied, give us a call today at (804) 447-1002. We can get you in for a free consultation and put you on the road toward your goal of receiving disability benefits.
